Welcome to VepiFind! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sande Technologies ("Company," "we," "us," or "our") regarding your use of the VepiFind mobile application (the "App" or "Service").

By downloading, installing, accessing, or using VepiFind, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use VepiFind.

2. Eligibility

To use VepiFind, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Permitted Use

VepiFind is provided for the following purposes:

• Searching for job opportunities
• Submitting job applications
• Managing your career profile and applications
• Receiving job recommendations and notifications
• Using AI-powered tools for cover letters and interview preparation

5. Prohibited Activities

When using VepiFind, you agree NOT to:

• Provide false, misleading, or fraudulent information
• Impersonate another person or entity
• Create multiple accounts for deceptive purposes
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users or employers
• Post or transmit spam, viruses, or malicious code
• Collect or harvest user information without consent
• Violate any applicable laws or regulations
• Use the Service to compete with or harm our business

Violation of these prohibitions may result in immediate account termination and legal action.

You are solely responsible for all content you submit through VepiFind, including:

• Cover letters
• Profile information
• Job applications
• Messages and communications

6.2 Content Standards

All user content must:

• Be accurate and truthful
• Not violate any third-party rights
• Not contain offensive, defamatory, or illegal material
• Comply with applicable laws and regulations

6.3 License to Use Content

By submitting content to VepiFind, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your content
• Share your application materials with employers
• Use aggregated, anonymized data to improve our services
• Generate AI-powered recommendations and content

You retain ownership of your content. We will only use your content as necessary to provide the Service and as described in our Privacy Policy.

6.4 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

7. AI-Generated Content

VepiFind uses artificial intelligence to generate cover letters, interview questions, and job recommendations. You acknowledge that:

• AI-generated content is provided as a tool to assist you
• You are responsible for reviewing and editing AI-generated content before submission
• We do not guarantee the accuracy, quality, or suitability of AI-generated content
• Final responsibility for all submitted applications rests with you
• AI recommendations are suggestions and not guarantees of job placement

8. Job Listings and Applications

8.1 Third-Party Job Postings

VepiFind aggregates job listings from various sources. We:

• Do not guarantee the accuracy of job postings
• Are not responsible for the content of job listings
• Do not guarantee interviews or job offers
• Are not party to any employment relationship formed through the App

8.2 Application Submission

When you apply for a job through VepiFind:

• Your application is submitted directly to the employer
• We facilitate but do not control the hiring process
• Employers make all hiring decisions independently
• We are not responsible for employer actions or responses

8.3 No Employment Guarantee

VepiFind is a job search tool. We do not guarantee:

• Job interviews or offers
• Employment outcomes
• Salary or compensation levels
• Employer responses to applications

9. Fees and Payment

VepiFind is currently free to use. We reserve the right to:

• Introduce premium features with associated fees
• Modify pricing for paid features
• Offer subscription plans

Any future charges will be clearly communicated to you in advance. You will not be charged without your explicit consent.

10. Intellectual Property Rights

10.1 Our Rights

VepiFind and all its contents, features, and functionality are owned by Sande Technologies and are protected by:

• Copyright laws
• Trademark laws
• Patent laws
• Other intellectual property laws

10.2 Trademarks

"VepiFind" and related logos are trademarks of Sande Technologies. You may not use our trademarks without prior written permission.

10.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use VepiFind for personal, non-commercial purposes, subject to these Terms.

11. Disclaimers and Limitations of Liability

11.1 "As Is" Service

VepiFind is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content
• Uninterrupted or error-free operation

11.2 No Guarantee of Results

We do not guarantee that:

• You will find employment through VepiFind
• Your applications will be successful
• Job listings are accurate or current
• The Service will meet your specific requirements

11.3 Limitation of Liability

To the maximum extent permitted by law, Sande Technologies shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages resulting from employer actions or third-party conduct
• Errors or inaccuracies in job listings or AI-generated content

Our total liability for any claim arising from your use of VepiFind shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sande Technologies, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of VepiFind
• Your violation of these Terms
• Your violation of any third-party rights
• Your user content
• Your interactions with employers or other users

13. Privacy and Data Protection

Your use of VepiFind is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using VepiFind, you consent to our privacy practices as described in the Privacy Policy.

14. Third-Party Services and Links

VepiFind may contain links to third-party websites, services, or job postings. We are not responsible for:

• The content of third-party sites
• Third-party privacy practices
• Third-party terms and conditions
• Any damages arising from your use of third-party services

Your interactions with third parties are solely between you and the third party.

15. Modifications to Service and Terms

We reserve the right to:

• Modify, suspend, or discontinue any feature of VepiFind
• Change the availability of the Service
• Implement new features or requirements

We will attempt to provide reasonable notice of significant changes but are not obligated to do so.

15.2 Terms Updates

Your continued use of VepiFind after changes constitutes acceptance of the updated Terms.

16. Termination

16.1 By You

You may terminate your account at any time by:

• Deleting your account through App settings

16.2 By Us

We may suspend or terminate your access to VepiFind immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Legal or regulatory requirements

16.3 Effect of Termination

Upon termination:

• Your right to use VepiFind immediately ceases
• Your account and data may be deleted
• Provisions that should survive termination will remain in effect

17. Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malawi, without regard to conflict of law principles.

17.2 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at sandetechnologiesmw@gmail.com to attempt to resolve the dispute informally.

17.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in Lilongwe, Malawi, in accordance with the Arbitration Act of Malawi.

17.4 Class Action Waiver

You agree that any dispute resolution shall be conducted on an individual basis and not as a class action or representative proceeding.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sande Technologies regarding VepiFind.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
